These Terms and Conditions (“Terms”) govern all bookings and services provided by Jaliya Boat Safari (Pvt) LTD (“Company”, “we”, “us”, or “our”). By making a reservation via our website (www.jaliyaboatsafari.lk), telephone, WhatsApp, or any other communication channel, you (“Customer”, “Guest”, or “you”) agree to be bound by these Terms.
1. BOOKING CONFIRMATION AND PAYMENT
1.1. All bookings must be prepaid in full at the time of reservation.
1.2. Accepted payment methods include cash, bank transfer, credit/debit cards, and online payment gateways approved by the Company.
1.3. A booking shall be deemed confirmed only upon receipt of full payment and issuance of a confirmation by the Company.
1.4. The Company reserves the right to decline or cancel any booking where payment has not been successfully received.
2. PRICING, CURRENCY AND ELIGIBILITY
2.1. Prices are quoted in:
- (a) Sri Lankan Rupees (LKR) for Sri Lankan residents; and
- (b) United States Dollars (USD) for foreign nationals.
2.2. The Company reserves the right to request proof of residency or identification to determine applicable pricing.
2.3. Child rates apply at a reduced price for both local and foreign guests.
2.4. All prices are subject to change without prior notice; however, confirmed bookings will not be affected.
3. SERVICE DESCRIPTION
3.1. The Company provides guided boat safari services in the Madu River, Balapitiya.
3.2. Safari duration typically ranges between one (1) to three (3) hours, depending on the selected package.
3.3. Standard inclusions:
- (a) Boat with licensed operator/guide
- (b) Life jackets
- (c) Visits to designated locations including Cinnamon Island and temples
3.4. Optional activities (subject to additional charges):
- (a) Fish therapy
- (b) Kayaking
3.5. Certain elements of the safari, including wildlife sightings and environmental conditions, are not guaranteed and are beyond the Company’s control.
4. CUSTOMER ARRIVAL AND DELAYS
4.1. Customers are required to arrive at the designated departure location: 206 Road Bridge View, Balapitiya, Sri Lanka
4.2. Customers must arrive at least fifteen (15) minutes prior to the scheduled departure time.
4.3. Delays of up to two (2) hours may be accommodated at the Company’s discretion, subject to operational availability.
4.4. Delays exceeding two (2) hours may result in:
- (a) Cancellation without refund; or
- (b) Rescheduling or continuation subject to additional charges.
5. CANCELLATION AND REFUND POLICY
5.1. Cancellations made seventy-two (72) hours or more prior to the scheduled safari shall be eligible for:
- (a) A full refund; or
- (b) Rescheduling without additional charge.
5.2. Cancellations made less than seventy-two (72) hours prior shall be eligible for:
- (a) A maximum refund of fifty percent (50%); or
- (b) Rescheduling, subject to availability and Company discretion.
5.3. Refund processing times may vary depending on the payment method used.
5.4. Bank charges, transaction fees, or currency conversion costs may be deducted from refunds where applicable.
6. WEATHER, SAFETY AND OPERATIONAL DECISIONS
6.1. The Company reserves the absolute right to determine whether weather or river conditions are unsafe for operation.
6.2. In such circumstances, the Company may:
- (a) Reschedule the safari; or
- (b) Provide a full or partial refund, at its discretion.
6.3. Safety-related decisions made by the Company are final and binding.
7. CAPACITY AND ALLOCATION
7.1. The Company operates multiple boats with varying capacities.
7.2. Boat allocation shall be determined based on group size and operational requirements.
7.3. The Company reserves the right to assign, combine, or adjust boat arrangements to ensure efficient service delivery.
8. HEALTH, SAFETY AND CUSTOMER RESPONSIBILITIES
8.1. Life jackets are provided and must be worn where instructed.
8.2. Children are permitted; however, they must be supervised by a responsible adult at all times.
8.3. Customers must comply with all safety instructions issued by the Company’s staff.
8.4. Customers are required to disclose any medical conditions, physical limitations, or special requirements prior to the safari.
8.5. Customers with medical conditions (including but not limited to heart conditions, pregnancy, mobility limitations, or inability to swim) participate entirely at their own risk.
8.6. The Company reserves the right to refuse service to any individual who poses a safety risk to themselves or others.
9. LIMITATION OF LIABILITY
9.1. To the fullest extent permitted by law, the Company shall not be liable for:
- (a) Personal injury, illness, or death arising from participation in the safari
- (b) Loss, theft, or damage to personal belongings
- (c) Delays, interruptions, or cancellations caused by external factors
- (d) Wildlife interactions or environmental conditions
9.2. All activities are undertaken at the Customer’s own risk.
10. FORCE MAJEURE
10.1. The Company shall not be liable for any failure or delay in performance due to events beyond its reasonable control, including but not limited to:
- Natural disasters
- Flooding or extreme weather
- Government actions or restrictions
- Public health emergencies
10.2. In such cases, the Company will endeavor to provide alternative arrangements or refunds where reasonably possible.
11. DATA PROTECTION AND PRIVACY
11.1. The Company collects and processes personal data solely for booking, operational, and communication purposes.
11.2. Personal data will not be disclosed to third parties except where necessary to provide services or comply with legal obligations.
12. GOVERNING LAW AND JURISDICTION
12.1. These Terms shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka.
12.2. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
